NOTICE OF MEETING


The Port Commissioners of the Port of Corpus Christi Authority of Nueces County, Texas, will meet in regular session on Tuesday, November 9, 2004 at 9:00 a.m., at the Congressman Solomon P. Ortiz International Center, 402 Harbor Dr., Corpus Christi, Texas.

Persons with disabilities who plan to attend this meeting and who may need auxiliary aids or services are requested to contact Sherry Tower at 882-5633 at least 48 hours in advance so that appropriate arrangements can be made.

PUBLIC NOTICE is given that the Commission may go into executive session at any time during the meeting in order to discuss matters listed on the agenda, when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code. In the event the Commission elects to go into executive session regarding any agenda item, the section or sections of the Open Meetings Act authorizing the executive session will be publicly announced by the presiding officer.

The agenda is as follows:

  1. Call meeting to order and receive conflict of interest affidavits.

  2. Take action to approve the minutes of the October 12, 2004, Commission meeting.

  3. Take action to adopt an Environmental Policy Statement for the Port of Corpus Christi Authority as required for the Environmental Management System..

  4. Discuss change in Port of Corpus Christi Workers’ Compensation Insurance Programe.

  5. Take action on proposal from Mercator Transport Group for an updated assessment of the La Quinta Market Potential Study.

  6. The following items are of routine or administrative nature. The Port Commission has been furnished support documentation on each item, and all such items may be acted upon by one vote without being discussed separately unless requested by a Port Commissioner.

    1. Award a contract to Universal Conveyor & Construction LLC, for Purchase of Conveyor for Rail Load-Out Pad at Bulk Dock 2 as the lowest and best bidder based on bids received October 29, 2004.

    2. Ratify a change order and approval of contingency with Rabalais I & E Constructors for the Security Grant #2 – Lighting and Video Improvements project.

    3. Approve a change order with Haas Anderson Construction Ltd.’s contract for Parking Lots Serving the Baseball Stadium for expansion of parking for the Ortiz Center.

    4. Approve a Professional Service Purchase Order with Kleinfelder for geotechnical testing for the Parking Lots Serving the Baseball Stadium.

    5. Approve the City of Corpus Christi platting fees for the Parking Lots Serving the Baseball Stadium.

    6. Approve additional engineering fees for LNV Engineering for the design of the parking lots serving the Baseball Stadium.

    7. Approve a Professional Services Agreement with Mark Stein to perform inspection services on the Fulton Corridor Project.

    8. Approve a Professional Services Purchase Order with RVE, Inc., for Security Grant #1 Design and Project Management Services.

    9. Approve a Professional Services Purchase Order with RVE, Inc., for Security Grant #2 Design and Project Management Services.

    10. Approve a Professional Services Purchase Order with RVE, Inc., for Security Grant #3 Design and Project Management Services.

    11. Approve a Professional Services Purchase Order with RVE, Inc., for Vessel Traffic Information System Design and Project Management Services.

    12. Approve Project Service and Timeline Agreement with Verizon, Southwestern Bell, and Tideland Signal Corporation for the Port of Corpus Christi Authority VTIS project.

    13. Approve a change order with Adesta, LLC, for Security Grant #1 – Video Surveillance Improvements.

    14. Approve a Professional Services Purchase Order with Weston Solutions, Inc., for air monitoring services during security construction.

    15. Ratify Local Cooperation Agreements with Nueces and San Patricio Counties relative to property forfeitures.

    16. Approve amendment to Port of Corpus Christi Health & Dental Benefits Plan.

    17. Approve maintenance agreement with Sirius Computer Solutions for two Iseries computers, associate peripherals, software subscription, alert service and support line.

  7. Take action to approve amendment to contract for refurbishment of Fire Barge Schwing Boom.

  8. Receive presentation on the Gulf Coast Strategic Highway System.

  9. Take action on $5 million line of credit from First National Bank.

  10. Take action to approve independent auditors for 2004 audit.

  11. Take action to approve revised Investment Policy.

  12. Receive reports and recommendations from the Executive Director and Chief Financial Officer on matters relating to the operation of the port.

  13. Receive Third Quarter Investment Report.

  14. Receive comments from the Public.

  15. Receive comments from the Commissioners.

  16. The Port Commission will go into a closed meeting:

    1. Pursuant to §551.071 of the Texas Government Code, to seek the advice of the Port Authority's counsel about pending or contemplated litigation, or a settlement offer;
    2. Pursuant to §551.071 of the Texas Government Code, to consult with the Port Authority's counsel on matters in which the duty of such counsel under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act;
    3. Pursuant to §551.072 of the Texas Government Code, to deliberate the purchase, exchange, lease or value of real property, because such deliberations in an open meeting would have a detrimental effect on the Port Authority's position in negotiations with third persons;
    4. Pursuant to §551.086 of the Texas Government Code, to discuss or deliberate commercial or financial information that the Port Authority has received from a business prospect that the Port Authority seeks to have locate, stay or expand in or near the territory of the Port Authority and with which the Port Authority is conducting economic development negotiations; and
    5. Pursuant to §551.086 of the Texas Government Code, to deliberate the offer of a financial or other incentive to a business prospect described in "D" above.
    6. Pursuant t§551.076 of the Texas Government Code, to deliberate the deployment, or specific occasions for implementation, of security personnel or devices; and
    7. Pursuant to §551.074 of the Texas Government Code, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of an employee, or to hear a compliant or charge against an employee.
